Post 40 days and not recieved my item

I bought shoes from Aliexpress on 4th of November and when I track the item it has been on 'exports customs scan' since the 10th of November, so it has been over a month since I ordered my item and it still hasn't come, the seller keeps saying I should be patient, but I've been very patient and am tired of waiting now

wait one more week, if you dont get the goods, open dispute to aliexpress.
