Post Item Stuck or Missing!?

Hi,
I use China Post and other international services from China and other parts of Asia all the time and this is the first time I have had a major issue.
I placed an order on December 12, the shipping information was provided on December 18th with tracking number: LS384343270CN
It says it has been in Shanghai EMS, China for many weeks now.
Normally, international packages from Asia get to me in 7-10 days but this one has been out for about 20 days.

I was wondering if anyone on here could help explain this issue, and if I should talk to my seller for a refund as it seems like the item is lost or rejected.

http://track-chinapost.com/startusa.php shows the parcel was shipped on Dec 19. normally it should arrive with 21 days. If not , you should open dispute to aliexpress.

But the item hasn't moved at all in nearly 20 days... wouldn't that be a sign that something has gone wrong? http://track.track-chinapost.com/china-ems/LS384343270CN this site provides a bit more detailed tracking info and says the item left for JFK airport NY on the 19th... as far as I understand this package should be in the USA but is not.

that is why I suggest you to open dispute to aliexpress.
